We cannot guarantee that any menu item is completely free from allergens due to the nature of our kitchen operations.

If you have a severe food allergy or dietary restriction, please notify us before ordering. Hangry Joe's shall not be held liable for adverse reactions resulting from undisclosed dietary restrictions or failure to review available allergen information.

13. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Hangry Joe's is registered and operates, without regard to conflict of law principles that would require the application of the laws of a different jurisdiction.

You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be brought exclusively in the federal or state courts of competent jurisdiction in the state where Hangry Joe's maintains its principal place of business, and you hereby consent to the personal jurisdiction and venue of such courts.

For customers located in California, these Terms are subject to the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), as applicable, as well as California's Unfair Competition Law (Cal. Bus. & Prof. Code § 17200 et seq.). For all customers nationwide, applicable provisions of the Federal Trade Commission Act (15 U.S.C. § 41 et seq.) shall apply to consumer protection matters.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating any formal legal proceedings, both parties agree to make a good faith effort to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Services (collectively, "Dispute") through informal negotiation. You must contact Hangry Joe's at [email protected] with a written description of your Dispute and proposed resolution. We will attempt to respond within thirty (30) calendar days. Both parties agree to engage in good faith discussions for a period of sixty (60) calendar days before pursuing formal dispute resolution.

14.2 Binding Arbitration

If the parties are unable to resolve a Dispute through informal negotiation within the period described above, either party may elect to resolve the Dispute through binding arbitration. Such arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA) or JAMS, as mutually agreed upon, and shall be conducted in the English language.

The arbitration shall be conducted by a single neutral arbitrator. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs and attorneys' fees in connection with arbitration, unless the arbitrator determines that the claim was frivolous or brought in bad faith.

14.3 Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION AGAINST HANGRY JOE'S. ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY.

14.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration. Nothing in this section shall prevent Hangry Joe's from seeking injunctive relief to protect its intellectual property rights.

15. Term and Termination

These Terms shall remain in full force and effect for so long as you access or use our Website or Services. Hangry Joe's reserves the right, in our sole discretion and without prior notice, to:

• Terminate or suspend your account and access to the Services;
• Remove or delete any User Content or orders;
• Refuse service to any person or entity for any reason not prohibited by law.

Grounds for termination include, but are not limited to: violation of these Terms, engaging in fraudulent activity, abusive conduct toward staff or other users, chargebacks or payment disputes found to be unwarranted, or any other conduct that Hangry Joe's reasonably determines to be harmful to the business, other customers, or third parties.

Upon termination, your right to use the Services ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: Intellectual Property Rights, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution.

Hangry Joe's reserves the right to modify, update, or replace these Terms of Service at any time at our sole discretion. When we make material changes to these Terms, we will:

In the event of a force majeure event, we will make reasonable efforts to notify affected customers and resume normal operations as soon as practicable. Orders affected by force majeure events may be cancelled or rescheduled without liability to either party.
